1- Introduction

These Website Standard Terms and Conditions written on this webpage shall manage your use of this website. These Terms will be applied fully and affect your use of the Website www.yournewyorkstory.com . By using this Website, you agree to accept all terms and conditions written in this document. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions.

2- Intellectual Property Rights

Under these Terms, Your New York Story LLC owns all the intellectual property rights and materials contained in this Website. You are granted a limited license only for purposes of viewing the material contained on this Website. You are specifically restricted from publishing any Website material in any other media without prior authorization and credit to the Website. Authorization requests shall be emailed to laurene@yournewyorkstory.com . Selling, sublicensing and/or otherwise commercializing any Website material is strictly prohibited. Publicly performing and/or showing any Website material is not permitted.

3- General

The guided tours and activities offered in the « guided tour” section of the website “www.yournewyorkstory.com” are organized by Your New York Story LLC, registered in the United States in the State of New York. The present general conditions of sale concern any reservation of guided tours or activities with Your New York Story LLC.

4- Terms and definitions 

• The term « participant » refers to the person attending the guided tour or the activity operated by Your New York Story LLC.
• The term « guided tour » refers to walking or biking tours or any other activity operated in NYC by Your New York Story LLC. Those tours are guided by a licensed guide from NYC holder of a valid licence delivered by the DCA ( Department of Consumer Affairs). Other activities that do not include a guided tour are operated by a professional in its field.
• The term “user” refers to the person using the website www.yournewyorkstory.com to make a reservation. 
• The term “activity’ refers to a service different from a guided tour like a photoshoot for example.
• The term “Website” refers to www.yournewyorkstory.com .

5 – Order with Your New York Story LLC

Payment implies acceptance of these terms and conditions of sale on the website www.yournewyorkstory.com. The user must verify the accuracy of the information provided by e-mail to laurene@yournewyorkstory.com. Your New York Story LLC can not be responsible for any misreported information. A payment can be made on the website directly, or per venmo or bank transfer. Once payment has been made and validated, the guided tour or activity will be confirmed  per email. The user will receive a payment confirmation email and an order confirmation email with the logistical details associated with the activity.

6 – Cancellation Cases

6.1 – Specific conditions

6.1.1 – Cancellation by Your New York Story LLC

Your New York Story LLC reserves itself the exclusive and discretionary right to cancel a tour due to weather conditions (snow storm, hurricane and / or heavy rain …) or in case of cancellation of a partner operating the activity. In the event of cancellation by Your New York Story LLC the tour may be postponed without charge at a later date or refunded in full.

6.1.2 – Cancellation by participants

In case of cancellation more than 7 days before the day of the guided tour, the price of the tour will be fully reimbursed minus  a fee of $20.

In case of cancellation less than 7 days before the tour, the price of the tour is not refunded.

In case of a participant with a positive covid test, the participants will receive a refund.

6.2 – Cancellation request procedure

To request the cancellation of a tour or activity, contact us at laurene@yournewyorkstory.com. Be sure to specify your name and the date of the guided tour or activity.

6.3 Group guided tours : Minimum 4 participants

Please note that group tours will be maintained if there are minimum 4 participants. If this is not the case, Your New York Story LLC will contact you to propose a new date or  offer a full refund. There are no minimum participants for private guided tours.

7 – In case of delay

We recommend that you arrive at the meeting point at least 15 minutes before the start time of the tour. If you arrive late, the tour cannot be extended beyond the scheduled time and the delay cannot give rise to a refund.

8 – Terms of payment

8.1 – General

Full payment for the tour or activity must be made in advance to validate a reservation. Payment is made by internet, at the time of booking or order, by bank transfer or credit card, through the secure electronic payment system developed by the specialized platform Stripe. Bring with you your confirmation sent per email printed out.

For bookings over $500, a minimum deposit of 30% is required and the remaining 70% must be paid 7 days before the start of the tour.

8.2 – Tipping

In the United States, it is customary to tip any person offering a service. The range for tips vary between 15% and 25%.

9- No warranties

This Website is provided “as is,” with all faults, and Your New York Story LLC issues no warranties, of any kind related to the website www.yournewyorkstory.com or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.

10 – Limitation of Liability of Your New York Story LLC

10.1- General

In terms of liability, Your New York Story LLC is not liable in the following cases:

• Inaccuracies of the information reported during the order.
• Impersonation during the order process.
• Damage in case of interrupted internet connection.
• In the event of an accident during a guided tour or an activity.
• Stolen items during a tour or an activity
• Injury in relation to a tour or an activity

10.2 – Acceptance of risks

By accepting these terms and conditions of sale, you acknowledge having read and understood the following risks, which cannot be anticipated:

• Accident during a guided tour or activity.
• Physical or physical injury.
• Behavior of passersby.
• Public events taking place in New York.

You accept the liability associated with these risks and you confirm that you cannot hold New York Prive LLC liable for any guided tour or activities.

10.3- Your personal belongings

Your New York Story LLC cannot be held responsible for personal belongings left unattended, lost or stolen during a guided tour or activity.

10.4- limitations

In no event shall Your New York Story LLC, nor any of its officers, directors or employees , shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. Your New York Story LLC, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

11 – Proof of an order

The data recorded when ordering a guided tour or an activity constitute the proof of the sale. Once the payment has been made, the user receives a payment confirmation and an order confirmation in two separate emails. 

12 – Privacy

• Your New York Story LLC collects personal data as part of order management and booking a tour or activity. The information collected is the following: surname, first name, e-mail address, telephone for the User as well as last name and first name of each participant in the guided tour or activities. This information is used to ensure the proper booking process and logistics for the tour. 
• The user may at any time access this information and request that it be modified or deleted at Your New York Story LLC by sending an e-mail request to the following address: laurene@yournewyorkstory.com.

13 – In case of disputes

Those General Terms and Conditions are subject to the law of the State of New York. Any dispute relating to their performance will be subject to the jurisdiction of the competent courts.

14 –  Update of Terms

Your New York Story LLC is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
